U.S. Tax Forms

Do I Need To File a Tax Form?

ALL international students who were in the U.S. for any days in 2016 must complete an IRS Form 8843 for the U.S. Internal Revenue Service (IRS). It is required by U.S. federal law even if you did not work.

If you did not work in the U.S. in 2016, you will not pay any taxes, but you are still required to complete Form 8843.

If you did work in the U.S. in 2015, you are required to file a complete tax return which includes Form 8843 and Form 1040 NR or NR-EZ to determine if you owe taxes or if you are due a refund. The filing deadline is April 15, 2017. Depending on your tax status, you may be required to file a California State tax return as well.

We highly recommend using the online tax preparation service called Sprintax to guide you through the tax filing process and avoid IRS penalties and fines. For most students, this only takes about 20 minutes.

Filing fees vary depending on which forms you need to file. Sprintax will determine which forms you are required to file based on your visa and whether you earned income in the U.S. or not.

Why Do I Have to File Tax Forms?

1. The most important reason to file a return is that it is a legal requirement of the United States.

Failing to file may impact the status of your current visa and make future US visa applications

difficult.

2. Avoid penalties – If you miss the April 15th deadline you may face late filing penalties. Filing

prior to this date prevents this, so the earlier you file, the better.

3. If you worked in the U.S. you may be owed a tax refund – most international students filing a tax

return are due a tax refund for overpaid tax. The average refund is $800 - $1000. It’s worth checking

if you are due a refund.
